TasScript Terms of Access and Use

1. Introduction

Health practitioner access and use of the information available in TasScript is conditional on these Terms of Access and Use (the Terms). You are required to carefully read, and agree to, these Terms before accessing and using TasScript.

TasScript is managed and authorised by the Tasmanian Government.

2. Application of These Terms

By accepting these Terms, and continuing to access and use TasScript, you agree to be bound by these Terms.

These Terms will apply in addition to all other obligations you have in relation to TasScript under law, including under Tasmania’s Poisons Act 1971 and regulations, Tasmania’s Personal Information Protection Act 2004 and the Australian Government Privacy Act 1988 as relevant.

Your obligations under relevant laws will prevail over these Terms to the extent of any inconsistency.

The Tasmanian Government has the right to change these Terms at any time by publishing an updated version of the Terms on this website.

3. Access

To access this site you will be required to register with TasScript, this will involve an identity verification process.

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account or password. You must only use your own account and password when accessing the TasScript website. Health practitioners are not to share their login and password details with another person. If you breach this obligation which results in another person using this site with your login details, you are responsible and liable for the use that person makes of this site as if that person were you. If you become aware of unauthorised access to your TasScript account, you must notify the Tasmanian Government, Department of Health, Pharmaceutical Services Branch immediately:

You must take all reasonable measures to ensure access to TasScript is via a secure device and not on a publicly accessible or shared device.

Health Practitioners are bound by Tasmania’s Poisons Act, Tasmania’s Personal Information Protection Act (state service employees only) and the Australian Government Privacy Act, as relevant, when accessing patient information via TasScript. Health practitioners are also bound by Codes of Conduct, Guidelines and Policies applicable to them as registered health practitioners under the Health Practitioner Regulation National Law.

Health practitioners are permitted to access an individual’s patient information available in TasScript if they are directly involved in the patient’s care. If you do access a patient’s record in TasScript, you will need to make sure you can substantiate this access in your capacity as their registered health practitioner.

It is not appropriate as a health practitioner to view your own profile as a patient or to view information in TasScript regarding an individual who is not currently in your clinical care.

Access to patient files on TasScript are logged and audited, with the following information recorded: username of the individual, time of access and records that have been accessed.

The Tasmanian Government is not liable for Viruses or other forms of interference that may damage your equipment. You must take precautions to ensure the process you employ to access this website does not expose you to such risks.

4. Scope of TasScript

The contents of TasScript is made available for clinical information purposes and to assist you to fulfill your legal obligations under the Poisons Act and the Poisons Regulations.

The information provided through TasScript is collected from a number of sources but may not include all prescriptions or supplies of monitored medicines. Further, the Tasmanian Government does not have any control over the accuracy of the data created by prescribers or dispensers in relation to monitored medicines.

If you believe there is an error in a prescription record contained in TasScript, the prescription record can be corrected by amending the details in the prescribing or dispensing software. The corrected information will then be automatically updated in TasScript.

The information on TasScript does not provide specific clinical. TasScript is intended as a clinical decision support tool which provides access to a history of prescribed and dispensed monitored medicines for patients enabling prescribers and pharmacists to make more informed clinical decisions prior to prescribing or dispensing a monitored medicine.

It remains the prescriber’s or pharmacist’s professional responsibility to decide whether treatment with the monitored medicine is clinically appropriate. The Tasmanian Government recommends that you exercise your own professional skill and care with respect to your use of this website and carefully evaluate the accuracy, currency, completeness and relevance of information on this website for your purposes.

It is intended that TasScript will form part of the national real-time prescription monitoring system, allowing prescribers and dispensers to access information held in other States and Territories in making treatment decisions in Tasmania. This will also mean that information about Tasmanian prescriptions and dispensing events may be accessible to health professionals outside of Tasmania.

5. Use and Disclosure of Information

The Tasmanian Government values the privacy of every individual’s personal information and is committed to protecting the information collected in compliance with the terms of relevant laws. Health Practitioners using TasScript are not to use and/or disclose any personal information obtained from TasScript HP unless it complies with those laws.

You must use TasScript only for lawful purposes as described by the Poisons Act 1971 and the Poisons Regulations 2018.

You acknowledge that TasScript contains personal information of health practitioners and patients, and that this information must be kept confidential and used only for the purposes permitted by Tasmania’s Poisons Act and regulations, Tasmania’s Personal Information Protection Act (state service employees only) and the Australian Government Privacy Act, as relevant.

You must not use or disclose information in TasScript unless you are authorised by or under relevant laws to do so.

You must not do anything that has an impact on the performance of this website nor interfere with the operation of TasScript or the display of information on TasScript pages. This includes attempting to gain unauthorised access to the secure areas of this website.

In using TasScript, you agree that our electronic record of your use is a true and correct record and will be relied on as such.

To the extent permitted by law, the Tasmanian Government will not be liable in contract, tort or otherwise for any loss or damage arising directly or indirectly as a result of your use or reliance on the information, content and data contained within, or communicated using, this website.

6. Privacy

You acknowledge that personal information about you will be collected, accessed, used, disclosed and otherwise dealt with by the Tasmanian Government in accordance with Tasmania’s Poisons Act and regulations, Tasmania’s Personal Information Protection Act, Tasmania’s Right to Information Act 2009 and the Australian Government Privacy Act.

7. Copyright

The Tasmanian Government owns the copyright in the contents of this website, including the images, graphics, text and their arrangement on this website, which are all subject to copyright and other intellectual property protection.

You may access and display these pages electronically. All other use, copying or reproduction (including reproduction on any other website) of any part of this website is prohibited.

This website may contain content that is subject to the intellectual property rights of third parties.

8. Third Party Websites and Applications

TasScript may contain links to websites and mobile applications owned and operated by third parties, who are not under the control of the Tasmanian Government.

The Tasmanian Government does not approve, endorse, recommend or sponsor these linked sites and/or applications, their owners or operators, or any information, graphics, materials, products or services referred to or contained on those linked websites and mobile applications, unless specifically stated.

The Tasmanian Government is not responsible for the content of these linked websites and mobile applications and makes no representation as to the accuracy of any material on these websites or mobile applications.

The Tasmanian Government, to the extent permitted by law, will not be liable in contract, tort or otherwise for any loss or damage either directly or indirectly arising as a result of your use of these third-party websites and mobile applications, or reliance on the information contained within. The terms and conditions, terms of use and privacy policies of those third-party websites and mobile applications will apply to your use of those websites and mobile applications.

9. No Warranties

This website is provided on an “as is” and “as available” basis with all faults, defects, bugs and errors.

The Tasmanian Government makes no warranty, express or implied, that the data or other information included in, accessed or used through the website is correct, current or complete.

All express, implied and statutory warranties including (without limitation) any warranties of fitness for a particular purpose and merchantability are hereby excluded to the extent permitted by law.

10. Suspension or Termination of access

The Tasmanian Government through the Department of Health can suspend or terminate your access and use of this website at its sole discretion, for any reason, at any time, including if:

  • This website is used by you in breach of these Terms of access and use;

  • There is a breach of security in respect of which the Department reasonably believes that the suspension of this website is necessary to protect this website or the Department’s network or a third party network;

  • Due to unavailability of third party networks and/or services, including without limitation telecommunications and ISP services; or

  • Required by law, regulation or court order or as compelled by a law enforcement or government agency or other relevant regulatory agency

11. General

Governing Law and Jurisdiction

The Terms are governed by and construed according to the laws in force in the State of Tasmania, Australia, and you irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Tasmania.

Entire Terms

The Terms constitute the entire agreement between you and the Tasmanian Government relating to TasScript and all previous representations and arrangements are superseded by these terms of access and use.

Severability

The invalidity or unenforceability of any provision of the Terms shall not affect the rest of the provisions in the Terms, which will continue in full force and effect.

No Waiver

No provision of the Terms will be taken to be waived except by written notice signed by you and the Tasmanian Government.
